Protecting landowners from punitive state eminent domain laws was the goal of the legal brief Ohio Farm Bureau submitted to the Supreme Court of the United States. Previously, Supreme Court precedent prohibited Ohioans from appealing to federal court to address government property takings. Ohio Farm Bureau’s brief sought to overturn precedent and gain landowners the option to appeal directly to a federal court. The court agreed with this position.
Curtis said with this ruling, if a taking occurs, be it a physical taking or a regulatory taking, a claim can be filed in federal court for the judge to hear if there was indeed a taking and what the compensation should be, and then the landowner could appeal through the federal system.
